Fair Work Commission decides apprentice rates case
The Fair Work Commission has determined a number of applications to vary apprentice rates in modern awards in a long running award modernisation case. The tribunal has decided to adjust first and second year rates and include adult apprentice rates in all modern awards that contain apprentice provisions. The new rates will be phased in commencing with new apprentices who start their apprenticeships from 1 January 2014.
The decision included a new requirement for the payment of excess travel expenses where apprentices attend block release training which requires staying away from home, and clarification of payment of TAFE fees, requiring the employer to reimburse the apprentice within 6 months. Fees will also include reimbursement for textbooks where the tectbooks form part of the fees. The decision is subject to the finalisation of orders varying each award.
